There has recently been a significant increase in large-scale construction
defect litigation in Arizona. This trend has significantly increased the
premiums contractors must pay for commercial general liability insurance
and, in some cases, has left them unable to obtain coverage.
Udall attorneys understand that the outcome of a construction defect claim
may have serious consequences for the continued operation of the
contractor¹s business, as well as it license.

Udall attorneys in this practice area have strong experience in
developing defense strategies that result in successful outcomes for our
clients. We counsel and represent material suppliers, manufacturers,
contractors and subcontractors, as well as architects and engineers, in
residential and commercial construction defect litigation. Some of the
trades we represent include electrical, grading, drywall, patio and
retaining walls, concrete flatwork, deck and balcony weatherproofing, and
plumbing. Our attorneys are also experienced at defending complaints filed
with the Arizona Registrar of Contractors.

While the common "shotgun" approach to construction defect litigation often
results in frivolous lawsuits against defendants with no substantial
relationship to the core defect issues, we understand from our experience in
defending construction claims that there are cases in which home or building
owners are legitimately damaged by shoddy construction practices,
substandard materials or poor design.  For that reason, we also represent
home or building owners in litigation to recover for defects in
construction, materials or design.
