Ed Moomjian, a partner with Udall Law Firm, has obtained a $6.8 million settlement in a plaintiff’s class action against United Artists Theatre Circuit, Inc. and its advertising agent, American Blast Fax. On September 27, 2011, the Maricopa County Superior Court gave final approval to the settlement, sending the case into the claim phase. View a copy of the approval order.
In September 1999 the defendants sent a fax advertising discount movie tickets to phone numbers in Maricopa County, Arizona. Mr. Moomjian and his co-counsel proceeded to file a class action lawsuit on behalf of Starkle Ventures, LLC alleging the facsimile advertising violated the Telephone Consumer Protection Act, 47 U.S.C. § 227. The Court certified the class, which consists of those who received the fax. The parties recently reached an agreement to settle, creating a settlement fund in excess of $6.8 million to pay class members, costs of suit, attorneys’ fees and class representative incentive awards, subject to the Court’s final approval of the proposed settlement.
